Terms of Service

These Terms govern access to the Neogen Esports website, in-house events, drafting tools, rosters, statistics, and related community services.

1. Acceptance of these Terms

By creating an account, registering for an event, or otherwise using the Service, you agree to these Terms of Service and acknowledge our Privacy Policy. If you do not agree, do not use the Service.

If you participate in an event with additional published rules, those rules also apply. Event-specific rules control for that event if they clearly address the conflicting subject; otherwise, these Terms control. Event rules cannot remove rights that applicable law does not permit you to waive.

Electronic notices

You agree that account, event, security, and legal notices may be provided electronically through the Service, the connected Discord community, or the contact method associated with your account. We do not use registration information for promotional marketing.

2. Independent operator and eligibility

This website and online service, branded as Neogen Esports (the “Service”), is independently owned and operated by Jeremy Chung in Louisiana, United States. Jeremy Chung owns and operates the Service but does not own or operate the Neogen Esports organization.

You must be at least 18 years old and located in the United States or Canada. You represent that you meet these requirements and are legally able to agree to these Terms.

You are responsible for following the laws that apply where you live and participate. You may not use the Service where doing so or joining a particular event would be unlawful.

3. Accounts and player information

  • You must control the Discord account and Riot account you connect to the Service.
  • You may not submit another person’s Riot ID without authorization, impersonate another player, or provide materially false account information.
  • You are responsible for the security and activity of your Discord account and for promptly reporting suspected unauthorized use.
  • You may not share accounts, create accounts for another person, or use multiple accounts to evade restrictions, suspensions, event rules, or administrative decisions.
  • You should keep your main and secondary role preferences reasonably accurate.

Account and Riot verification information is handled as described in the Privacy Policy. Registering an account does not guarantee eligibility for or participation in any event.

We may ask for reasonable proof that you meet account or event eligibility requirements. A future tournament offering a prize may require identity, age, location, or other eligibility verification before a prize is awarded, but any such requirement will be disclosed in the applicable event rules.

4. In-houses, tournaments, and prizes

Community in-houses

In-house events offered through the Service are free to enter. Event dates, registration windows, capacity, formats, captains, draft rules, timers, and other details may change. Registration does not guarantee a roster position, captain assignment, team placement, or participation.

You are responsible for arriving on time, monitoring event communications, and complying with event instructions. Missed or expired draft turns may be skipped automatically. Technical problems may require administrators to pause, correct, restart, reschedule, or cancel an event or draft.

Future organized tournaments

The Service may later offer separately organized tournaments that require an entry fee. Before payment or registration, any paid tournament will provide additional rules describing eligibility, format, entry fees, refund and cancellation terms, prize allocation, minimum participation, and other material conditions. You will not be charged unless you separately agree to those rules and payment terms.

Prizes are not guaranteed unless expressly announced in written event rules. Announced prizes may depend on participation, eligibility verification, event completion, and compliance with applicable Riot Games policies and law. The Service does not permit betting, wagering, or gambling.

Game operation and connections

We organize events but do not operate League of Legends, Discord, internet connections, or participant devices. Players remain responsible for their own game accounts, hardware, software, connectivity, and compliance with Riot Games rules. Disconnects, game-client failures, third-party outages, or inaccurate third-party data may affect an event and may require an administrative ruling.

5. Player conduct

You must treat players, captains, administrators, and community members respectfully. You may not:

  • Harass, threaten, stalk, discriminate against, or target another person with hateful or abusive conduct.
  • Cheat, collude, manipulate results, exploit bugs, interfere with drafts or timers, or obtain an unfair competitive advantage.
  • Impersonate another person, misrepresent an account, evade a ban, or obstruct an administrative investigation.
  • Post spam, malware, malicious links, unlawful material, or content that infringes another person’s rights.
  • Use offensive, discriminatory, misleading, infringing, or sexually explicit team names or other content.
  • Attempt unauthorized access to the Service, database, API credentials, accounts, or infrastructure.
  • Collect another user’s personal information without authorization, publish private information, or use the Service to send unsolicited messages.
  • Introduce malware, probe for vulnerabilities without written permission, evade technical limits, overload the Service, or interfere with another person’s access.

Conduct in connected Discord communities and League of Legends matches may affect eligibility when it relates to a Service event, threatens community safety, undermines event integrity, or violates these Terms.

6. Team names and user content

You retain any rights you have in team names and other original content you submit. You grant Jeremy Chung a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, format, and use that content as reasonably necessary to operate, secure, promote, and document the Service, events, rosters, and statistics.

You represent that you have the right to submit your content. We may reject, hide, edit, or remove content that violates these Terms, another person’s rights, event rules, or applicable law. Administrators may assign a neutral replacement name when necessary.

The license above lasts only as long as reasonably necessary to provide the Service and preserve legitimate event history. Account deletion does not require removal of deidentified completed rosters, draft results, or statistics retained as described in the Privacy Policy.

Feedback

If you voluntarily submit ideas or suggestions about the Service, you allow us to use them without restriction or compensation. This does not transfer ownership of unrelated materials or personal information included with your feedback, which remains subject to the Privacy Policy.

7. Event administration and enforcement

Administrators may reasonably reject or remove registrations, remove players from events, assign or reassign captains, modify rosters, correct draft results, cancel events, restrict features, suspend accounts, or permanently ban users to enforce rules, preserve event integrity, address misconduct, respond to technical failures, or protect the community.

Warnings will be provided when practical, but serious abuse, cheating, security threats, repeated violations, or legal risk may result in immediate action. Administrative decisions are final for ordinary event-management matters. You may appeal an account suspension or ban by contacting chung_jeremy@jproton.me.

8. Third-party services

The Service depends on services operated by Riot Games, Discord, Railway, CommunityDragon, jsDelivr, and other providers. Their separate terms and policies govern your relationship with them. We do not control and are not responsible for their availability, security, content, decisions, or independent practices.

You must comply with applicable Riot Games and Discord rules. A suspension or change affecting a connected third-party account may prevent you from using some or all of the Service.

9. Ownership and Riot Games disclaimer

Except for user content and third-party materials, the Service’s original software, design, text, and functionality are owned by Jeremy Chung or used with permission. These Terms do not transfer ownership to you.

League of Legends, Riot Games materials, game data, trademarks, and associated properties belong to Riot Games and their respective owners. Discord and other third-party names and marks belong to their respective owners.

Neogen Esports is not endorsed by Riot Games and does not reflect the views or opinions of Riot Games or anyone officially involved in producing or managing Riot Games properties. Riot Games and all associated properties are trademarks or registered trademarks of Riot Games, Inc.

Intellectual-property concerns

If you believe content on the Service infringes your copyright, trademark, or another intellectual-property right, contact chung_jeremy@jproton.me with your contact information, identification of the protected work, the location of the material, the basis for your claim, and a statement that the report is accurate and made in good faith. We may remove material while reviewing a report and may restrict repeat infringers.

10. Limited permission to use the Service

While you comply with these Terms, Jeremy Chung grants you a limited, personal, revocable, non-exclusive, non-transferable right to access and use the Service for its intended community and recreational purposes.

Except where applicable law permits otherwise, you may not copy or commercially exploit the Service; reverse engineer its non-public software; use bots, scrapers, or automated tools to extract data or interact with the Service without written permission; bypass access controls or rate limits; frame or mirror the Service; or use its data to create a competing database or service. Normal browser use, search-engine indexing authorized by us, and access through an expressly provided interface are not prohibited.

11. Availability and disclaimers

The Service is provided on an “as is” and “as available” basis to the fullest extent permitted by law. We do not guarantee uninterrupted operation, error-free drafts, event availability, team placement, competitive results, or the accuracy or continued availability of Riot, Discord, rank, role, timer, or statistical information.

We may modify, suspend, or discontinue features or the Service. When practical, we will provide reasonable notice of material discontinuation. You use the Service and participate in events at your own risk.

To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage. Mandatory rights that cannot legally be waived remain unaffected.

12. Limitation of liability

To the fullest extent permitted by law, Jeremy Chung will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of data, goodwill, opportunity, prizes, profits, or use; or conduct of other users or third-party services arising from or related to the Service.

To the fullest extent permitted by law, total liability arising from or related to the Service will not exceed the greater of the amount you paid directly for the Service during the 12 months before the event giving rise to the claim or USD $100.

Some jurisdictions do not allow certain exclusions or limitations. In those jurisdictions, these provisions apply only to the maximum extent permitted, and applicable consumer protections in the United States and Canada remain unaffected.

13. Responsibility for your violations

To the extent permitted by law, you are responsible for claims, losses, and reasonable costs arising from your unlawful conduct, your infringement of another person’s rights, content you submit, or your material violation of these Terms. This provision does not require you to compensate us for losses caused by our own unlawful conduct or negligence where such responsibility cannot legally be shifted.

14. Suspension, termination, and account deletion

You may stop using the Service at any time and may request account deletion as described in the Privacy Policy. We may suspend or terminate access for violations of these Terms, community-safety concerns, security risk, legal requirements, or discontinuation of the Service.

When reasonably practical, we will tell you why an account was suspended or terminated. We may withhold details where disclosure could endanger another person, compromise security or an investigation, or violate law.

After termination, provisions concerning ownership, user-content licenses needed for retained deidentified history, disclaimers, liability, disputes, and other provisions that by their nature should survive will remain effective.

15. Governing law and disputes

Before filing a legal claim, you agree to contact chung_jeremy@jproton.me and attempt in good faith to resolve the dispute informally for at least 30 days.

Except where mandatory law provides otherwise, these Terms and disputes concerning the Service are governed by Louisiana law, without regard to conflict-of-law principles. You and Jeremy Chung agree that claims will be brought in an appropriate state or federal court located in or serving Jefferson Parish, Louisiana, and consent to that court’s jurisdiction.

Mandatory consumer rights and jurisdictional protections applicable to residents of the United States or Canada are not waived. Nothing in these Terms prevents either party from seeking emergency injunctive relief or using an eligible small-claims process.

16. Changes and general provisions

We may update these Terms as the Service, events, vendors, or legal requirements change. Updated Terms will be posted here with a revised date. We will ordinarily provide at least 30 days’ notice before a material change that reduces your rights takes effect, unless an earlier change is reasonably necessary for security, legal compliance, abuse prevention, or a new feature you choose to use. We may request renewed agreement when appropriate.

If any provision is unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue. Failure to enforce a provision is not a waiver. Section headings are provided only for readability.

These Terms, the Privacy Policy, and applicable event rules form the entire agreement concerning the Service. You may not transfer your account or your rights under these Terms. We may transfer operation of the Service and these Terms as part of a legitimate transfer of the website, subject to applicable law and the Privacy Policy.
